Four Kinds of Settlement Number, and Why They Are Not Interchangeable
The single most useful thing this page can do is explain why two settlement figures that look comparable often are not comparable at all. There are four distinct kinds of number in mass tort litigation and they answer four different questions. A jury verdict is what one jury awarded one plaintiff on one set of facts, before any appeal; it is not a price list, and appellate courts reverse them regularly. An individual settlement is what one claimant accepted, almost always under a confidentiality clause, which is why so few are ever public. An aggregate settlement fund is a total commitment covering thousands of claims with the allocation decided later by an administrator. A statutory compensation formula is a schedule written into law or into a trust document, which produces the same answer for everyone who fits the same category.
Mixing those four is how almost every misleading settlement figure on the internet gets made. Dividing an aggregate fund by a claimant count is the most common version: Abbott’s roughly $670 million for the Gill case plus about 2,000 other infants averages around $335,000 each, but one affirmed $495 million judgment sits inside that total, so the average describes nobody. Quoting a verdict as a claim value is the second most common: three rideshare sexual assault cases have been tried and returned nothing, $8.5 million and $5,000 respectively — a 1,700-fold spread from the same litigation within seven months. And quoting government money as compensation is the third: Meta’s settlement with 51 attorneys general pays state treasuries, not families.
Statutory and trust formulas are the one place where a real number can be published for an individual, and even there the number is rarely the one people expect. Asbestos bankruptcy trusts apply a payment percentage to a scheduled disease value, and those percentages currently run from 3.5 percent to 65 percent depending on the trust. The Scouting Settlement Trust is paying 4.7 percent of an allowed claim, so an allowed claim of $2.7 million has produced roughly $126,900. Those are real, checkable figures precisely because the formula is published — and they are far below the headline totals the same programmes are described by.
