Why No Suboxone Settlement Figure Can Exist Before 2028

Suboxone is the clearest case on this site where a settlement figure cannot exist yet, and the reason is on the court’s own calendar. The Second Amended Case Management Order in MDL 3092 sets a March 2028 first trial setting. Nothing has been tried, no bellwether has reached a jury, and no global settlement or claims programme has been announced or approved. Indivior confirms the same position from the other side of the case: its quarterly filings record no provision for this litigation and state that no estimate of loss can presently be made, and the company tells investors that bellwether trials will not occur before the end of the first quarter of 2028. Three independent sources, all primary, all saying the same thing.

The docket is nonetheless substantial, and its size is routinely misreported because two different things are being counted. The Judicial Panel on Multidistrict Litigation counted 1,827 actions pending in MDL 3092 in its September 1, 2026 statistics report, before Judge J. Philip Calabrese in the Northern District of Ohio. Indivior counts plaintiffs, and reports roughly 26,307 of them across about 1,967 cases, plus around 4,854 additional claimants filed on Schedule A complaints and more than 950 tolled state claims. Neither figure is wrong. They measure different units, and pages that present them as rival counts of the same thing have misread at least one of the sources.

What the record does establish is the safety signal the litigation rests on. The FDA issued a Drug Safety Communication on January 12, 2022 warning of dental problems associated with buprenorphine medicines dissolved in the mouth. The agency identified 305 reported cases of dental adverse events through the end of 2018, 131 of them serious, including 71 tooth extractions; the mean age was 41.8 and the median time from starting the medicine to the reported event was just over two years. Twenty-six of the cases involved patients with no prior dental history. The FDA added a warning to the labels and stated in the same communication that the benefits of these medicines clearly outweigh the risks — a sentence that matters for treatment decisions and that this page will not omit.
