The paid settlements are not injury settlements. 3M agreed a settlement with a pre-tax present value of up to $10.3 billion over 13 years, with a nominal cap of $12.5 billion, granted final approval on 29 March 2024. DuPont, Chemours and Corteva agreed $1.185 billion in June 2023, and Tyco ($750 million) and BASF ($316.5 million) were approved on 22 November 2024. Every one of those resolved claims brought by public water systems. Figures such as $150,000 to $500,000 per injury claim are analyst projections, not payments anyone has received.

MDL 2873 is one of the largest environmental and product-liability proceedings in the country. Its water-contamination half has largely resolved. Its personal injury half has not.

Filing Deadlines

Limitation periods for AFFF injury claims vary by state and generally run from diagnosis, or from the point at which the connection between the diagnosis and PFAS exposure could reasonably have been discovered. Many claimants were exposed decades before diagnosis, so the discovery rule matters more here than in most litigation.

Claims brought by veterans and serving personnel may involve additional considerations, including federal claim procedures that run on their own timetable.

Those amounts can frequently be reduced through a formal resolution process, but the process adds time — often months between an agreed figure and a distributed payment.
