The appeal challenging the dismissal of the Tylenol autism and ADHD MDL is now underway. Plaintiffs argue that Judge Cote improperly excluded expert testimony linking Tylenol use during pregnancy to developmental disorders in children. The appeal claims the judge misapplied the Daubert standard, which ensures evidence is based on sound scientific principles, and wrongly took on the role of a scientist in deciding the medical dispute. The plaintiffs contend that the judge’s focus on public policy rather than scientific methods was inappropriate for the Daubert hearing.
As appeals take time, a ruling is not expected until early next year. We will provide updates as more information becomes available.
